Welcome to Pickle, Inc. ("Pickle," "we," "us," or "our").

These Terms of Use ("Terms") govern your access to and use of Pickle's products, software, hardware devices, services, websites, and applications (collectively, the "Services").

 

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use Pickle's Services.

1. Overview

Pickle provides a connected ecosystem of tools that allow you to capture, store, and interact with your personal memories through both software and hardware products.

 

Our ecosystem includes:

  • The Pickle platform — your personal memory bank, accessible through web or app.
  • Pickle software — tools for uploading, editing, deleting, and visualizing your data and memories.
  • Pickle-certified hardware — including Pickle I AR glasses and future certified devices capable of securely capturing photos, videos, audio, and contextual data.

 

Your use of any Pickle product or service is governed by these Terms as well as our Privacy Policy.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Pickle.

If you use Pickle on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

3. Your Account

To use many of our Services, you must create an account.

 

You agree to:

  • Provide accurate and complete information;
  • Maintain the confidentiality of your credentials;
  • Notify us immediately of any unauthorized access;
  • Be responsible for all activity under your account.

 

Pickle reserves the right to suspend or terminate accounts that violate these Terms or pose security risks.

4. Use of the Services

You may use the Services only for lawful, personal, and non-commercial purposes, unless expressly authorized by Pickle.

 

You agree not to:

  • Access or use the Services in any unlawful or harmful way;
  • Attempt to copy, reverse-engineer, or modify our systems or software;
  • Circumvent security or encryption technologies;
  • Upload or share content that infringes on intellectual property or privacy rights;
  • Use the Services to develop competing products or machine learning models;
  • Interfere with the operation or integrity of Pickle's systems.

5. Software and Hardware Products

5.1 Pickle Software

Our software allows you to view, edit, and manage your memories and related data.

 

You may:

  • Upload your personal content (text, images, videos, voice);
  • Modify, tag, and delete your stored memories;
  • Integrate third-party apps or data sources, if you choose.

 

You retain full ownership of your data. By using Pickle's software, you grant us a limited, encrypted, and revocable license to process your content solely to provide the Service.

5.2 Pickle I and Certified Hardware Devices

Pickle I and future certified hardware products are designed to capture environmental and sensory data (e.g., video, audio, contextual input) to enrich your personal memory system.

 

All Pickle hardware:

  • Processes raw inputs temporarily on-device or within a secure enclave;
  • Deletes all original raw data immediately after processing;
  • Transmits only derived, encrypted, text-based representations to your account.

 

Hardware devices may include embedded software updates and telemetry (non-personal system performance data) necessary for device functionality and safety.

5.3 Experimental Features and Beta Services

From time to time, we may offer beta or experimental features. These are provided "as-is" and may be modified or discontinued at any time.

6. Intellectual Property

All intellectual property rights in the Services, including software, firmware, designs, trademarks, and documentation, belong to Pickle or its licensors.

 

You may not copy, modify, distribute, or create derivative works of our Services without written permission. You retain ownership of your own data and memories, but grant Pickle a limited license to process and store them as described in the Privacy Policy.

7. Privacy and Data Handling

Your privacy and data security are central to Pickle's mission. Our data practices are governed by the Privacy Policy, which forms part of these Terms.

 

In summary:

  • You can delete your data anytime.
  • Raw photos, videos, and audio are deleted immediately after processing.
  • We do not sell or share your personal data.
  • We never use your memories or personal data to train large language models.

8. Device Safety and Use

Pickle devices (such as Pickle I) are designed for safe, personal use.

 

You agree to:

  • Follow all safety, maintenance, and usage instructions;
  • Avoid using devices while driving or in hazardous environments;
  • Not modify or tamper with the hardware;
  • Use only certified accessories and chargers.

 

Pickle is not responsible for injuries, damages, or data loss resulting from misuse, unauthorized repairs, or modifications.

9. Updates and Changes

Pickle may release updates, bug fixes, or improvements to its software or hardware. By using our Services, you agree that such updates may be automatically installed to ensure optimal performance and security.

 

We may modify or discontinue portions of our Services at any time. We will provide advance notice of significant changes via email or in-app notice.

10. Fees and Purchases

Certain features or hardware devices may require payment. By purchasing, you agree to:

  • Provide accurate billing and payment information;
  • Authorize us or our payment processor (e.g., Stripe) to process charges;
  • Comply with any applicable return or refund policies.

 

All payments are processed securely under our vendors' respective privacy and security standards.

11. Third-Party Integrations

You may connect external accounts (e.g., Gmail, Notion, Slack) to enrich your Pickle memory. Pickle does not assume responsibility for data handling by those third parties. We recommend reviewing their privacy policies before connecting integrations.

12. Termination

You may stop using Pickle at any time. You can delete your account and all data via settings or by contacting contact@pickle.com.

 

We may suspend or terminate your access if:

  • You violate these Terms;
  • Your actions threaten the integrity or security of the system;
  • We are required to do so by law.

 

Upon termination, your data will be deleted as outlined in our Privacy Policy.

13. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind. Pickle does not guarantee uninterrupted operation or error-free performance.

 

We disclaim all implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Pickle is not responsible for any data loss or device damage resulting from user misuse or third-party interference.

14. Limitation of Liability

To the fullest extent permitted by law:

  • Pickle will not be liable for any indirect, incidental, consequential, or punitive damages.
  • Our total liability for any claim relating to your use of the Services will not exceed the amount you paid (if any) for the Service during the preceding 12 months.

 

Some jurisdictions may not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Pickle and its affiliates, employees, and partners from any claims or damages arising from your:

  • Violation of these Terms;
  • Misuse of the Services;
  • Infringement of any third-party rights.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. You agree to resolve any disputes in courts located in San Francisco County, California, unless otherwise required by applicable law.

17. Changes to These Terms

We may update these Terms periodically. If material changes occur, we will notify you via email or in-app message. Continued use of our Services after such updates constitutes your acceptance of the revised Terms.

  • Transparency: We will always communicate clearly about data practices, system updates, and new product certifications.
  • Hardware Certification: Any future devices labeled "Pickle Certified" comply with our zero-knowledge and local-processing standards.
